Lawmaker says top issue for constituents is marijuana; oncologist advocates for safe access

Far and away the largest number of phone calls from constituents of Rep. Jason Nemes, R-Louisville, are in support of marijuana legalization, and he says he’s heard plenty of other lawmakers also getting the calls.

Nemes recently published online what voters are calling him about, and in a phone interview with Pure Politics he said the calls on marijuana come in three forms: advocating for medical marijuana in pill form, medical marijuana that can be smoked and full-scale state legalization of the federally illegal drug.

“I’m getting contacted on all three of those areas, I don’t know where I am on it, but the Kentucky Medical Association tells me there’s no studies that show that it’s effective,” Nemes said in a phone interview on Wednesday.

Dr. Don Stacy, a board certified radiation oncologist who works in the Kentucky and Indiana areas, said there’s a reason there’s no studies proving effectiveness — studies have not been allowed to take place.

“It’s one of those things where we can’t provide randomized phase three studies in cannabis without making it legal — that is the gold standard for any sort of medicine,” Stacy said. “We have a variety of studies of that nature from other countries of course, but American physicians are very particular about American data. The database we have now is plenty enough to say we shouldn’t be arresting patients for trying to help themselves.”

Stacy said he became interested in marijuana after he noticed some of his patients were doing better with treatment than similar patients. In reviewing their records and through private discussions with the patients, he learned “a significant portion” of those doing better were the patients using marijuana.

“I was surprised by that,” he said. “I’ve always been a skeptic of alternative medicines, but then I began to research the data. I was impressed with the data.”

Dr. Stacy said he’s had some particular patients who showed minor or moderate improvements or side effects, but patients who had to stop treatment because the toxicity of the treatment was so severe. The patients who had to stop treatment tried marijuana, and then they were able to complete their treatments showing “dramatic differences,” Stacy said.

Because of the improvements in patients, Stacy is advocating for safe and legal access to the drug.

Twenty-eight states and the District of Columbia allow access to medical marijuana in different forms. Through those states allowing access, Stacy said several show improvements outside of overall medical care.

In states that have legalized medical marijuana the suicide rate has dropped by 10 percent among males 18 to 40, he said.

“It says when people have serious medical or behavioral issues — if you cannot find the treatment that helps you then some people decide to end their lives, and cannabis apparently prevents a certain portion of people from doing that.”

Stacy said that there is also a 10 percent decrease in physicians prescribing narcotics in medical marijuana states. The effect of that, Stacy said is a 25 percent decrease in overdose deaths linked to narcotics in states with medical cannabis laws. With the level of heroin and opiate abuse in Kentucky, he said there would be positive effects seen here too.

“I think that one-quarter of the people who will overdose and die of narcotics in this state in this year would be alive if we had a medical cannabis law.”

Coal Miners continue to suffer on this, the last day of 2016….for some, nothing changes, it only gets worse.

Below is two stories which caught my eye this morning concerning coal mining and coal miners.  It is the last day of 2016 and still, they suffer.  Between job loss and illness and an ultimate death from Black Lung, these people who have worked their entire lives to dig coal so that we have electricity for all of our needs, have suffered their entire lives as slaves to the Corporate system, who entrenched them in this line of work.  Appalachia and surrounding area is home to some of the most poor people in America.  They were born into mining.  Entire families work in the mines.  They were never taught to do anything else.  And if they all quit today, what would we do for electricity to power all of the gadgets and contraptions that we rely on today, such as the laptop and light I am using now to write this?

President Nixon Signs Federal Coal Mine Health and Safety Act: December 30, 1969

 

On December 30, 1969, President Richard Nixon signed into law the Federal Coal Mine Health and Safety Act.  Since the Monograph mine disaster in Marion County more than 60 years earlier, Congress had been passing laws to address coal mine safety. However, most were filled with loopholes or lacked funding for enforcement.

The tide turned after another Marion County disaster. The 1968 Farmington explosion killed 78 miners. Americans watched in horror as the drama unfolded on national TV. 

After the disaster, Congressman Ken Hechler paid to bring hundreds of miners and the widows of the Farmington miners to protest at the nation’s capitol. Black lung doctors rallied miners in the coalfields and testified before Congress about unsafe mining conditions. And in the spring of 1969, 40,000 miners defied their union and went on strike to support the legislation.

The resulting law increased mine inspections; allowed the government to shut down unsafe mines; placed stricter limits on coal dust; improved ventilation, roof supports, and methane detection; and provided compensation to miners suffering from black lung. The landmark legislation ultimately led to a significant decrease in deaths from coal mining.

Advanced Black Lung Cases Surge In Appalachia

 

Across Appalachia, coal miners are suffering from the most serious form of the deadly mining disease black lung in numbers more than 10 times what federal regulators report, an NPR investigation has found.

The government, through the National Institute for Occupational Safety and Health, reported 99 cases of “complicated” black lung, or progressive massive fibrosis, throughout the country the last five years.

But NPR obtained data from 11 black lung clinics in Virginia, West Virginia, Pennsylvania and Ohio, which reported a total of 962 cases so far this decade. The true number is probably even higher, because some clinics had incomplete records and others declined to provide data.

“The actual extent of PMF in U.S. coal miners remains unclear,” says the report, which appears in this week’s issue of the Morbidity and Mortality Weekly Report, published by the Centers for Disease Control and Prevention.

“I can’t say that I’ve heard really anything worse than this in my career,” says Robert Cohen, a pulmonologist at the University of Illinois, Chicago who studies and tracks black lung.

“I can’t think of anything in this particular field … that’s more frightening than this,” Cohen adds.

Edward “Lee” Petsonk of West Virginia University has spent three decades addressing the disease and finds NPR’s numbers “very disheartening, very disappointing.”

“I’ve spent much of my career trying to find ways to better protect miners’ respiratory health,” Petsonk says. “It’s almost like I’ve failed.”

NIOSH released a report Thursday, published in the Morbidity and Mortality Weekly Report, which focuses on a small health clinic in Kentucky with 60 cases alone of PMF in 20 months. The report acknowledges cases are being missed by the government’s count; it concludes: “The actual extent of PMF in U.S. coal miners remains unclear.”

“The more I talk, the more I get out of breath”

Mackie Branham, 39, of Elkhorn Creek, Ky., spent 19 years mining coal until he was diagnosed with complicated black lung. He ran monstrous mining machines and drilled bolts into mine roofs — occupations NIOSH says can involve excessive mine dust exposure. He worked double shifts and seven-day weeks every chance he had.

His gallbladder was removed one day and he says he was back at work the next. He took two days, he says, after knee surgery, before working a 12-hour shift drilling bolts. But severe breathing problems forced him to leave work in March. And he struggles for every breath now.

“My dad has got it. Everybody that has got it, got it when they had like first stage or so. I’ll probably be the first born to be this bad in the family,” Branham says, describing a family legacy of black lung.

“They can’t breathe but they can still get up and walk around and do stuff. The more I talk, the more I get out of breath. It’s like I ain’t got no capacity.”

 

Branham was diagnosed with PMF at United Medical Group, a clinic in Coal Run Village, Ky., that was the subject of the NIOSH study. Radiologist Brandon Crum was alarmed by the numbers of miners coming in with such severe disease, including some like Branham, who were in their 30s and 40s and worked less than 20 years underground. So he contacted NIOSH researchers.

“I think the percentage of black lung that we’re seeing now here in central Appalachia is unprecedented in any recorded data that I can find anywhere,” Crum says. “In this clinic we’re roughly around 9 to 10 percent complicated rate, which is around three times higher than even the highest reported numbers.”

NIOSH researchers gathered at the clinic and verified the diagnoses. They, too, were alarmed.

 

Black Lung Returns To Coal Country

“The current numbers are unprecedented by any historical standard,” says NIOSH epidemiologist Scott Laney, who has focused on black lung as well as the recent Ebola outbreak in Africa.

“We had not seen cases of this magnitude ever before in history in central Appalachia.”

Crum tells NPR he diagnosed 10 more cases of PMF since Laney and his colleagues left the clinic.

In three years, 644 cases

Life with PMF is bleak. It’s incurable and fatal.

Fifty-three-year-old Charles Wayne Stanley of Pound, Va., is matter-of-fact about his future.

“Staying on oxygen 24/7, dying of suffocation, that’s what I’ve got to look forward to,” Stanley says, as he sits in a clinic in St. Charles, Va.

“I’ve seen it too many times. My wife’s grandpa … [I] watched him take his last breath. I watched my uncle die with black lung. You literally suffocate because you can’t get enough air. That’s my prospects.”

Stanley says his diagnosis includes black lung and silicosis.

In just the last three years, 644 cases of complicated black lung were diagnosed at Stone Mountain Health Services, which operates black lung clinics in St. Charles and two other Virginia communities. That’s six times the NIOSH national count in nearly half the time.

Ron Carson is the director of the Black Lung Program at Stone Mountain Health Services in St. Charles, Va. “Something major is going on,” he says.

“I’m not an epidemiologist or a scientist or a doctor,” says Ron Carson, who manages the clinics. “I just see the results that come through the doors, and something is going on. Something major is going on.”

Laney and his colleagues acknowledge in their paper that they have missed hundreds of cases with their national surveillance program. By law, they can X-ray only working miners and the testing is voluntary. NIOSH data show most miners avoid that testing. Only 17 percent of all working Kentucky miners were tested in the NIOSH program since 2011.

Stanley waited until he was out of work, after 30 years mining coal, before he got his first chest X-ray. Miners avoid the NIOSH testing, he says, because they worry it could cost them their jobs.

“If you’re working and you go and have that stuff done and the company finds out about it, they’ll find a way to get rid of you,” Stanley says. “As long as you’re working and producing you’re an asset. But now when you get something wrong with you, you become a liability. And they’ll find a way to get rid of you.”

The last company a miner worked for (for at least a year) is saddled with black lung benefits payments and medical care — even if the miner spent 20 years working somewhere else in excessive dust. It’s the last employer who pays.

But it’s against the law to punish or fire miners for getting X-rays or being diagnosed with disease. Bruce Watzman of the National Mining Association also says mining companies are not supposed to see the X-rays.

“Those results are not shared with any employer. It’s at the miner’s discretion the way the program operates today when and if to divulge that information,” Watzman says.

Still, the fear is widespread. So missing from the official NIOSH counts in the last 40 years are the working miners avoiding X-rays, and miners who are retired or laid off.

More than 40,000 miners lost their jobs since 2010. Six hundred mines have closed. And those out of work are now flocking to clinics to get screened for the disease and apply for black lung benefits. Last year alone, 3,000 miners showed up at the Stone Mountain clinics.

“I’m seeing miners now feeling that there’s no hope. I think that they have really come to the realization that there’s other energy out there now that is going to override any coal,” Carson says.

With the increased testing, more cases of complicated black lung are being diagnosed.

“Pure rock dust”

Cohen, Laney and other black lung experts believe thinner coal seams in central Appalachia are likely to blame for spikes in complicated black lung. The thickest seams are mostly gone. The thin seams that remain have coal embedded in rock, and that rock contains quartz. Cutting quartz and coal together results in mine dust that includes silica, which is especially toxic in lung tissue. Stanley worked in so much dust he labeled his mining machine the dust dragon.

“They kept getting less coal and more rock. So you’re cutting 19 inches of coal, you’re cutting 50-60 inches of rock,” Stanley recalls. “And the more rock you cut the more dust you’re going to eat.”

The three public hearings on the proposed Medicaid waiver have been completed, with approximately 400 individuals in attendance in Bowling Green, Frankfort and Hazard, KY and nearly 100 individuals who spoke. 98% of those who spoke expressed concerns about the proposed waiver. Concerns were expressed about requiring the “medically frail” to pay monthly premiums; about a work or volunteer requirement of 20 hours/week for those on the Medicaid Expansion; loss of retroactive eligibility which could cause a lapse in coverage or a delay in beginning Medicaid coverage; increasing premiums over several years for some Medicaid members, with a 6-month lock-out from services if the premium is not paid; eliminating annual dental and vision check-ups and routine care for the Medicaid Expansion folks
Clearly those Medicaid members who are deemed to be “medically frail” (by a process yet to be determined, but ostensibly those with SMI. Chronic SUD, complicated medical conditions, are on SSI, or have a disability that interferes with a task of daily living) will be charged a monthly premium, probably in the range of $1 – $8 / month. We are concerned both by the financial burden, but also by the administrative burden created by this requirement. If the premium is not paid, then the medically frail individual will have to pay a copay for every service and every medication! While the 1915 C Waivers are exempt from this current 1115 Waiver Proposal from the Administration, we are concerned about individuals who are currently covered by Medicaid while waiting for a 1915 waiver slot. They would likely be classified as “medically frail” and would be subject to a monthly premium; if not paid, then they would be charged a copay for each health service and each medication they receive.
Medically frail individuals will not have a work or volunteer requirement and will have the full range of current benefits, including dental and vision. These latter benefits (annual check-up, routine cleanings, etc.) are being removed from the benefit package for all other Medicaid members (excluding children and pregnant women); those basic health benefits will have to be “earned” by the member through their Rewards Account.

Seeds of Destruction: The Hidden Agenda of Genetic Manipulation

Last three or four years have seen a number of books, documentaries and articles on the dangers of Genetically Modified (GM) seeds. Majority has focused on adverse health and environmental impact; almost none on the geo-politics of GM seeds, and particularly seeds as a weapon of mass destruction. Engdahl has addressed this issue but the crop seed is one of the many “Seeds of Destruction” in this book.

Engdahl carefully documents how the intellectual foundations of ‘eugenics,’ mass culling of the sick, coloured, and otherwise disposable races, were actually first established, and even legally approved, in the United States. Eugenics research was financially supported by the Rockefeller and other elite families and first tested on Jews under Nazi Germany.

It is purely by chance that world’s poorest nations also happen to be best endowed with natural resources. These regions are also the ones with growing population. The fear among European ruling families, increasingly, integrating with economic and military might of the United States, was that if the poor nations became developed, the abundant natural resources, especially oil, gas, and strategic minerals and metals, may become scarcer for the white population. That situation was unacceptable to the white ruling elite.

The central question that dominated the minds of the ruling clique was population reduction in resource rich countries but the question was how to engineer mass culling all over the world without generating powerful backlash as it was bound to happen. When the US oil reserves peaked in 1972 and it became a net oil importer, the situation became alarming and the agenda took the centre stage. Kissinger, one of the key strategists of Nixon, nurtured by the Rockefellers, prepared what is known as National Security Study Memo (NSSM#200), in which he elaborated his plan for population reduction. In this Memo he specifically targets thirteen countries: Bangladesh, Brazil, Colombia, Egypt, Ethiopia, India, Indonesia, Nigeria, Pakistan, Turkey, Thailand, and The Phillipines.

The weapon to be used was food; even if there was a famine food would be used to leverage population reduction. Kissinger is on record for stating, “Control oil, you control nations; control food and you control the people.” How a small group of key people transformed the elitist philosophy, of controlling food to control people, into realistic operational possibility within a short time is the backdrop of Engdahl’s book, the central theme running from the beginning till the end with the Rockefellers and Kissinger, among others, as the key dramatis personae.

He describes how the Rockefellers guided the US agriculture policy, used their powerful tax-free foundations worldwide to train an army of bright young scientists in hitherto unknown field of microbiology. He traces how the field of Eugenics was renamed “genetics” to make it more acceptable and also to hide the real purpose. Through incremental strategic adjustments within a handful of chemical, food and seed corporations, ably supported by the key persons in key departments of the US Government, behemoths were created that could re-write the regulatory framework in nearly every country. And these seeds of destruction of carefully constructed regulatory framework- to protect the environment and human health- were sown back in the 1920s.

Pause to think: a normal healthy person can at the most go without food for perhaps seven days but it takes a full season, say around four months, for a seed to grow into food crop. Just five agri-biz corporations, all US based (Cargill, Bunge, Archer Daniels, et al), control global grain trade, and just five control global trade in seeds. Monsanto, Syngenta, Bayer, DuPont, and Dow Chemicals control genetically engineered seeds. While these powerful oligopolies were being knocked into place, anti-trust laws were diluted to exempt these firms. Engdahl writes, “It was not surprising that the Pentagon’s National Defense University, on the eve of the 2003 Iraq War, issued a paper declaring: ‘Agribiz is to the United States what oil is to the Middle East.’ Agribusiness had become a strategic weapon in the arsenal of the world’s only superpower.” (page 143)

The “Green Revolution” was part of the Rockefeller agenda to destroy seed diversity and push oil and gas based agriculture inputs in which Rockefeller’s had main interest. Destruction of seed diversity and dependence on proprietary hybrids was the first step in food control. (See my notes, Box 1)

It is true that initially Green Revolution technologies led to spurt in farm productivity but at a huge cost of destruction of farmlands, bio-diversity, poisoned aquifers and progressively poor health of the people and was the true agenda of ‘the proponents of Green Revolution.’

The real impetus came with the technological possibility of gene splicing and insertion of specific traits into unrelated species. Life forms could be altered. But until 1979, the US Government had steadfastly refused to grant patent on life form. That was changed [my comment: helped much by a favorable judgment in the US Supreme Court granting patent protection to oil eating bacteria developed by Dr Ananda Chakraborty]. Life forms could now be patented. To ensure that the world surrendered to the patent regime of the seeds corporations, the World Trade Organization was knocked into shape. How it conducted business was nobody’s business, but it forced the world to accept intellectual property right of these corporations. There is opposition but these firms are too determined as Engdahl describes.

“The clear strategy of Monsanto, Dow, DuPont and the Washington Government backing them was to introduce the GMO seeds in every corner of the globe, with priority on defenceless …..African and developing countries,” write Engdahl (page 270). However, Engdahl also describes how US and Canadian farmlands came under GMOs. It was suspected that GMO could pose serious threat to human and animal health and the environment, yet efforts at independent biosafety assessment were discontinued. Scientists carrying out honest studies were vilified. Reputed scientific establishments were silenced or made to toe the line that was supportive of the Rockefeller’s food control and mass culling agenda. The destruction of the credibility of scientific institution is yet another seed of destruction in Engdahl’s book.

Engdahl cites the example of a German farmer Gottfried Glockner’s experience with GM corn. Glockner planted Bt176 event of Syngenta essentially as feed for his cows. Being a scientist, he started with 10% GM feed and gradually increased the proportion, carefully noting milk yield and any side effects. Nothing much happened in the first three years but when he increased the feed to 100% GM feed, his animals “were having gluey-white feaces and violent diarrhea” and “milk contained blood.” Eventually all his seventy cows died. Prof Angelika Hilbeck of Swiss Federal Institute of Technology found from Glockner’s Bt 176 corn samples Bt toxins were present “in active form and extremely stable.” The cows died of high dose of toxins. Not if, but when human food is 100% contaminated should be a sobering thought.

In the US unlabelled GM foods were introduced in 1993 and that 70% of the supermarket foods contain GMOs in varying proportions in what should rightly be called world’s largest biological experiment on humans. While Engdahl has clearly stated that the thrust of US Government and the agi-biz is control over food especially in the third world, he has left it to the readers to deduce that American and European citizens are also target of that grand agenda. And there are more lethal weapons in the arsenal: Terminator seeds, Traitor seeds, and the ability to destroy small independent farmers at will in any part of the world, and these are powerfully presented in the book. Engdahl provides hard evidences for these seeds of final destruction and utter decimation of world civilizations as we have known.

It is a complex but highly readable book. It is divided into five parts, each containing two to four short chapters. The first part deals with the political maneuverings to ensure support to Seed and Agri-biz firms, the second deals with what should be widely known as ‘The Rockefeller Plan’, the third deals with how vertically integrated giants were readied for Washington’s silent wars on planet earth, the fourth part deals with how GM seeds were unleashed on unsuspecting farmers, and the final part deals with how the elites is going on destroying food, farmers that would eventually cause mass culling of population. He does not offer any solution; he can’t because it is up to the rest of the world, including Europeans and Americans, to wake up and take on these criminals head on. An essential read for anyone who eats and thinks.

Democratic Sen. Perry Clark spoke at the Mensa Annual Gathering in Louisville on Wednesday in an effort to clear the smoke about myths surrounding cannabis.

Clark was one of several presenters invited to the four-day Mensa event at the Galt House.

The organization asked Clark to speak about the myths beginning in the early 1900s surrounding cannabis, hemp and the continued propaganda from opponents of cannabis legislation. 

With the 2016 legislative session less than six months away, Clark said he hopes to have meaningful conversations about legalizing cannabis with fellow lawmakers where baseless propaganda has kept a stigma on the plant and hindered support for his past bills. 

“We don’t understand why it has been criminalized under a mountain of lies for the last 90 years,” Clark said. “We do know that alcohol and tobacco companies have funded the opposition to cannabis legislation in other states. We talked about the roots of the opposition from the early 1930s and ’40s.”

Clark said the discussion on his topic among Mensa members, a nonprofit organization open to people who score in the 98th percentile on an IQ test, brought out similar concerns he had with legalizing cannabis or medical marijuana. 

“We all agreed we were concerned about teen use and kids getting their hands on edibles (cannabis products marketed like popular candy brands in states where recreational marijuana is legal),” Clark said.

“But it’s time to drop the fear surrounding this plant. We’ve spent billions of dollars over the years fighting it in the War on Drugs and really there is no moral justification.”

Hill to climb

The hill cannabis legislation has had to climb in Kentucky, Clark said, includes the continued opposition from critics who have said there are no medical studies proving the medical benefits of cannabis. 

“The cover story on National Geographic this month shows there are several government studies on marijuana,” Clark said. “The big change (for Kentucky and other states) will come in 2016 when the U.N. votes on its drug policies. The worst thing that can happen to someone who uses marijuana is they get arrested and it ruins their life. Where has all the War on Drugs money gone?”

Clark has long been an advocate for medicinal marijuana and has updated bills for the last four years mirroring states where medicinal and medical marijuana have become law. 

During the 2015 legislative session, Clark almost daily brought up topics relating to the benefits of medical marijuana to fellow senators including a study showing a reduction in opiate addiction where medical marijuana had been legalized. 

40 provisions

Clark’s Senate Bill 40 contained provisions for the cultivation and dispensing of cannabis to patients in the commonwealth. 

Currently, in Colorado where medicinal and recreational marijuana have been legalized the state government has brought in $96 million in tax revenue. 

According to information from Gov. John Hickenlooper’s office, the state has three taxes on recreational marijuana and one on medical marijuana. 

Medical marijuana has a 2.9 percent sales tax. Recreational marijuana has a 15 percent excise tax when it is transported from a cultivation site to a processing site or retail location. An additional 10 percent special sales tax on recreational marijuana is added to an existing 2.9 percent sales tax. 

A spokesperson from the governor’s office said the state uses the 15 percent excise tax to pay for the construction of public schools and since those taxations have been put in place has collected $40 million.

Framework taken from the Jack Herer Initiative aka CCHI1013. An initiative I had the honor of having a personal hand helping to word, redefining the cannabis/marijuana/hemp movement through selective wording. While attempting to protect and free the plant, the farmers, the prisoners, and the people from validating and mandating over regulation and enslavement through the legal lies = legalize = “common words used”  commonly leading us to Corporate G.M.O.’s = {genetic mutated organisms} which “equal genetically modified crops”, seed ownership through patent, small farmers being sued or enslaved,… While they continue to build their Military Industrial Complex with our tax dollars, lives…  So it seems only appropriate I use it as a base to follow and put it forth here within the Commonwealth of Kentucky.

 

AN ACT TO AMEND THE HEALTH AND SAFETY CODE OF THE COMMONWEALTH OF KENTUCKY:

I. Add Section ________ to the Health and Safety Code of the Commonwealth of Kentucky, to amend, nullify, restore through repeal of any and all unconstitutional laws or policies to the contrary, including those on the Federal and U.N. Levels, notwithstanding,:

1. No person, individual, or corporate entity shall be arrested or prosecuted, be denied any right or privilege, nor be subject to any criminal or civil penalties for the possession, cultivation, transportation, distribution, or consumption of cannabis hemp marijuana, including:

         (a) Cannabis hemp industrial products.
         (b) Cannabis hemp medicinal preparations.
         (c) Cannabis hemp nutritional products.
         (d) Cannabis hemp religious and spiritual products.
         (e) Cannabis hemp recreational and euphoric use and products.

   2. Definition of terms:

    (a) The terms “cannabis hemp” and “cannabis hemp marijuana” mean the natural, non-genetically modified plant hemp, cannabis, marihuana, marijuana, cannabis sativa L, cannabis Americana, cannabis chinensis, cannabis indica, cannabis ruderalis, cannabis sativa, or any variety of cannabis, including any derivative, concentrate, extract, flower, leaf, particle, preparation, resin, root, salt, seed, stalk, stem, or any product thereof.

    (b) The term “cannabis hemp industrial products” means all products made from cannabis hemp that are not designed or intended for human consumption, including, but not limited to: clothing, building materials, paper, fiber, fuel, lubricants, plastics, paint, seed for cultivation, animal feed, veterinary medicine, oil, or any other product that is not designed for internal human consumption; as well as cannabis hemp plants used for crop rotation, erosion control, pest control, weed control, or any other horticultural or environmental purposes, for example, the reversal of the Greenhouse Effect and toxic soil reclamation.

    (c) The term “cannabis hemp medicinal preparations” means all products made from cannabis hemp that are designed, intended, or used for human consumption for the treatment of any human disease or condition, for pain relief, or for any healing purpose, including but not limited to the treatment or relief of: Alzheimer’s and pre-Alzheimer’s disease, stroke, arthritis, asthma, cramps, epilepsy, glaucoma, migraine, multiple sclerosis, nausea, premenstrual syndrome, side effects of cancer chemotherapy, fibromyalgia, sickle cell anemia, spasticity, spinal injury, stress, easement of post-traumatic stress disorder, Tourette syndrome, attention deficit disorder, immunodeficiency, wasting syndrome from AIDS or anorexia; use as an antibiotic, antibacterial, anti-viral, or anti-emetic; as a healing agent, or as an adjunct to any medical or herbal treatment. Mental conditions not limited to bipolar, depression, attention deficit disorder, or attention deficit hyperactivity disorder, shall be conditions considered for medical use.

   (d) The term “cannabis hemp nutritional products” means cannabis hemp for consumption by humans and animals as food, including but not limited to: seed, seed protein, seed oil, essential fatty acids, seed cake, dietary fiber, or any preparation or extract thereof. Not Taxable

  (e) The term “cannabis hemp euphoric products” means cannabis hemp intended for personal recreational or religious use, other than cannabis hemp industrial products, cannabis hemp medicinal preparations, or cannabis hemp nutritional products.

(f) The term “personal use” means the internal consumption of cannabis hemp by people 18 years of age or older for any relaxational, meditative, religious, spiritual, recreational, or other purpose other than sale.

(g) The term “commercial production” means the production of cannabis hemp products for sale or profit under the conditions of these provisions.

  (h) The term “non-genetically modified ” is used to define or establish the Prohibition of any and all Unnatural “genetically modified organism (GMO)” is used to refer to any microorganism, plant, or animal in which genetic engineering techniques have been used to introduce, remove, or modify specific parts of its genome of any and all cannabis, cannabis sativa L, marijuana, hemp,…. Examples include plants being modified for pest resistance; lab animals being manipulated to exhibit human diseases, such as sickle cell anemia; and even glowing jellyfish genes inserted in a rabbit for an art piece.

  (i) The term “genetic engineering” involves isolating individual DNA fragments, coupling them with other genetic material, and causing the genes to replicate themselves. Introducing this created complex to a host cell causes it to multiply and produce clones that can later be harvested and used for a variety of purposes. Current applications of the technology include medical investigations of gene structure for the control of genetic disease, particularly through antenatal diagnosis. The synthesis of hormones and other proteins (e.g., growth hormone and insulin), which are otherwise obtainable only in their natural state, is also of interest to scientists. Applications for genetic engineering include disease control, hormone and protein synthesis, and animal research.

3. Industrial cannabis hemp farmers, manufacturers, processors, and distributors shall not be subject to any special zoning requirement, licensing fee, tax that is excessive, discriminatory, double taxation or prohibitive.

4. Cannabis hemp medicinal preparations are hereby restored to the list of available medicines in the Commonwealth of Kentucky. Licensed physicians shall not be penalized for, nor restricted from, prescribing or recommending cannabis hemp for medical purposes to any patient, regardless of age. No tax shall be applied to prescribed cannabis hemp medicinal preparations. Medical research shall be encouraged. No recommending physician shall be subject to any professional licensing review or hearing as a result of recommending or approving medical use of cannabis hemp marijuana. Cannabis hemp nutritious foods are medicine and therefore are subject to current Commonwealth Food & Drug Tax Code Exemptions

5. Personal use of cannabis hemp euphoric products.

  (a) No permit, license, or tax shall be required for the non-commercial cultivation, transportation, distribution, or consumption of cannabis hemp.

(b) No unconstitutional Testing for inactive and/or inert residual cannabis metabolites shall not be allowed for employment or insurance, nor be considered in determining employment, other impairment, or intoxication, or qualifications for benefits, programs or education,…  Including Protections of Families, against Unconstitutional Testing for Cannabis residual,… and/or Cannabis Use shall not/can not be used to take Custody of children from their families, parents or legal guardians.

(c) When a person falls within the conditions of these exceptions, the offense laws do not apply and only the exception laws apply.

6. Use of cannabis hemp products for religious or spiritual purposes shall be considered an inalienable right; and shall be protected by the full force of the State and Federal Constitutions.

7. Commerce in cannabis hemp euphoric products shall be limited to adults, 18 years of age and older, and shall be regulated in a manner analogous to the Commonwealth of Kentucky’s tobacco industry model. For the purpose of distinguishing personal from commercial production, 99 flowering female plants and 12 pounds of dried, cured cannabis hemp flowers, bud, not leaf, produced per adult, 18 years of age and older, per year shall be considered as being for personal use.

8. The manufacture, marketing, distribution, or sales between adults of equipment or accessories designed to assist in the planting, cultivation, harvesting, curing, processing, packaging, storage, analysis, consumption, or transportation of cannabis hemp plants, industrial cannabis hemp products, cannabis hemp medicinal preparations, cannabis hemp nutritional products, cannabis hemp euphoric products, or any cannabis hemp product shall not be prohibited.

9. No Commonwealth of Kentucky law enforcement personnel or funds shall be used to assist or aid and abet in the enforcement of Federal cannabis hemp marijuana laws involving acts which are hereby declared unconstitutional, therefore no longer illegal, as they are considered repealed and nullified in the Commonwealth of Kentucky.

10. Any person who threatens the enjoyment of these provisions is guilty of a misdemeanor. The maximum penalties and fines of a misdemeanor may be imposed.

II. Nullify, Repeal, delete, and expunge any and all existing statutory laws that conflict with the provisions of this initiative.

1. Enactment of this initiative shall include: amnesty, immediate release of custody from prison, jail, parole, and probation, and clearing, expungement, and deletion of all criminal records and/or all social/family service records/cases for all persons currently charged with, or convicted of any non-violent cannabis hemp marijuana offenses included in this initiative which are hereby no longer illegal in the Commonwealth of Kentucky. People who fall within this category that triggered an original sentence are included within this provision.

2. Within 60 days of the passage of this Act, the Commonwealth Attorney General shall develop and distribute a one-page application, providing for the destruction of all cannabis hemp marijuana criminal records in the Commonwealth of Kentucky for any such offense covered by this Act. Such forms shall be distributed to district and city commonwealth attorneys and made available at all police departments in the Commonwealth to persons hereby affected. Upon filing such form with any Superior Court and a payment of a fee of $10.00, the Court shall liberally construe these provisions to benefit the defendant in furtherance of the amnesty and dismissal provision of this section. Upon the Court’s ruling under this provision the arrest record shall be set aside and be destroyed. Such persons may then truthfully state that they have never been arrested or convicted of any cannabis hemp marijuana related offense which is hereby no longer illegal in the Commonwealth of Kentucky. This shall be deemed to be a finding of factual innocence under Kentucky Penal Code Section 218A.010, et seq.

3. Law abiding Cannabis Growers and Consumers retain the Right to possess Firearms as granted to them by the 2nd Amendment of the Constitution. For the use of their protection and prosperity which includes hunting.

III. The legislature is authorized upon thorough investigation, to enact legislation using reasonable standards to:

1. License concessionary establishments to distribute cannabis hemp euphoric products in a manner analogous to the Commonwealth of Kentucky’s tobacco industry model. Sufficient community outlets shall be licensed to provide reasonable commercial access to persons of legal age, so as to discourage and prevent the misuse of, and illicit traffic in, such products. Any license or permit fee required by the Commonwealth for commercial production, distribution or use shall not exceed $1,000.00 and not more than $500.00 per small farmer or small business.

2. Place an excise tax on commercial and corporate sale of cannabis hemp euphoric products, analogous to the Commonwealth’s tobacco industry model, so long as no excise tax or combination of excise taxes shall exceed $10.00 per ounce.

3. Regulate the personal use of cannabis hemp euphoric products in enclosed and/or restricted public places.

4. Exempt cannabis marijuana hemp from any and all farming tobacco “Base” laws, regulations, codes, statutes, which “restricted” or “limit” number of licenses,… based on science that “does not apply” to the agricultural cultivation, propagation, growth or farming of cannabis marijuana hemp which has been scientifically proven to reclaim, remove toxins and restore soil, ground water and our ozone.  

IV. Pursuant to the Ninth and Tenth Amendments to the Constitution of the United States, the people of the Commonwealth of Kentucky hereby nullify, repudiate and challenge Federal cannabis hemp marijuana prohibitions that are in conflict with this Act and our Constitutions, both Federal and our Commonwealth’s.

V. Severability: If any provision of this Act, or the application of any such provision to any person or circumstance, shall be held invalid by any court, the remainder of this Act, to the extent it can be given effect, or the application of such provisions to persons or circumstances other than those as to which it is held invalid, shall not be affected thereby, and to this end the provisions of this Act are severable.

VI. Construction: If any rival or conflicting initiative regulating any matter addressed by this act receives the higher affirmative vote, then all non-conflicting parts shall become operative.

VII. Purpose of Act: This Act is an exercise of the police powers of the Commonwealth for the protection of the safety, welfare, health, and peace of the people and the environment of the Commonwealth, to protect the industrial and medicinal uses of cannabis hemp, to eliminate the unlicensed and unlawful cultivation, selling, and dispensing of cannabis hemp; and to encourage temperance in the consumption of cannabis hemp euphoric products. It is hereby declared that the subject matter of this Act involves, in the highest degree, the ecological, economic, social, and moral well-being and safety of the Commonwealth and of all its people. All provisions of this Act shall be liberally construed for the accomplishment of these purposes: to respect human rights, to promote tolerance, to uphold the Constitutions both Federal and the Commonwealth’s and to end cannabis hemp prohibition. To nullify, repeal and challenge the U.N. to end cannabis marijuana hemp prohibition which is half of the worldwide so-called “War on Drugs”created to uphold the interest of Big Chema, Big Pharma, Big Corps and their Synthetic Military Industrial Prison Complex and to uphold the interest of the people and it’s own Universal Declaration of Human Rights for the reasons already stated with-in it.

Glasgow couple nears end of self-quarantine after Africa trip

Since Mike and Rosana Padgett returned from Africa about two weeks ago, they have managed to keep themselves busy.

Mike Padgett, pastor of Glasgow Bible Church, has been reading, studying and writing. He has also attended some meetings via the Internet. Rosana, meanwhile, a teacher’s aide for Barren County Schools, has been cleaning out closets and washing windows.

But there’s a twist: The couple volunteered to isolate themselves from the public for 21 days in the unlikely event the Padgetts contracted the Ebola virus during their trip. The self-quarantine ends Thursday.

Mike Padgett said this week they have shown no signs of the disease.

“We have no symptoms; absolutely zero,” he said Thursday.

The Padgetts traveled to Kenya to visit their daughter, Jessica, and their newly born grandchild. They spent 28 days in Africa, during which Mike worked with 40 missionaries in Kenya and Tanzania – two countries on the eastern coast of Africa, thousands of miles from the center of the Ebola outbreak on the continent’s western coast.

“We got home on Wednesday night, which would have been the 15th of October at 11 p.m.,” Mike Padgett said. “The next morning by 10 a.m., we had already had calls from the Barren County Board of Education, the hospital and the health department about where we’d been and what we’d done.

“At that time, the board of education was trying to decide what to do and how to handle it, because parents were very concerned about my wife, who is a teacher’s aide, being back at school and around the children. Of course, they were thinking we had been in an Ebola area.”

The Padgetts spoke with Barren County Schools officials, who granted Rosana Padgett three weeks of paid leave while the couple essentially quarantined themselves.

Amneal Undertakes Major Sales and Distribution Expansion in Kentucky

Newly-leased space in Glasgow will nearly double size of current operations

BRIDGEWATER, N.J., Sep 23, 2014 (BUSINESS WIRE) — Amneal Pharmaceuticals LLC (www.amneal.com), one of the largest generic drug suppliers in the U.S., has signed a lease for a second location in Glasgow, Kentucky that will nearly double the size of its national sales and distribution center.

Tony Hodges, Vice President for Global Logistics, discussed Amneal’s latest growth plans in the state at a Glasgow-Barren County Chamber of Commerce breakfast on September 12. The company was honored as the 2014 Industry of the Year, chosen by Chamber members, during the event.

Amneal acquired the lease at 40 Aberdeen Drive in the former Carhartt Building from Aphena Pharma Solutions, a medication packaging firm and Amneal supplier, which announced it will cease operations in Glasgow at the end of the month. The building will be refurbished to create a 120,000 sq. ft. warehouse and 6,000 sq. ft. of offices to support logistics. When the expansion is complete, the company’s Glasgow operations will occupy a total of 221,000 sq. ft.

Since 2007, Amneal’s Kentucky sales and distribution capabilities have grown dramatically (see Figure 1 here). Upon acquiring Akyma Pharmaceuticals that year, the company moved into its 3,000 sq. ft. offices at 104 Hippocrates Way and 30,000 sq. ft. warehouse in nearby Fountain Run. In 2010 Amneal consolidated distribution logistics and sales operations in-state rather than relocating these critical functions near its headquarters and manufacturing plants in metro New York by leasing a much-larger 115,000 sq. ft. facility at 118 Beaver Trail.

Amneal has invested over $6.6 million in Glasgow and created jobs for 80 Kentuckians to date, exceeding this year’s goal. Figure 2 (view here) shows actual employment growth from 2008-2014. Once the Aberdeen Drive expansion is complete, the generic maker will employ over 90 local residents.

For its earlier project, Amneal secured multi-year tax incentives through the Kentucky Economic Development Finance Authority (KEDFA) and the Kentucky Business Investment (KBI) program. The company also obtained an economic development loan from the Glasgow/Barren County Industrial Development Economic Authority, forgivable if agreed-upon headcount growth commitments are met. The KEDFA/KBI grant and Glasgow/Barren County loan were key factors in Amneal’s decision to remain and expand in Kentucky.

Although the financial incentives Amneal has received over the past several years are important, the company is also reaffirming its commitment to Glasgow due to its people.

“From our first opportunity to get to know Akyma’s employees prior to acquiring that business, we have been impressed with the work ethic, integrity, common sense, commitment to success and positive attitude of Kentucky’s citizens,” said Jim Luce, Amneal’s Executive Vice President-Sales & Marketing, who oversees the entire Kentucky operation. “The economic incentives definitely played a critical role in our decision to continue growing in Kentucky, though incentives and nice buildings aren’t worth anything without superb people.
